Privacy Policy (GDPR) and Cookie Policy of SEAMTRACK SL (Vigilo)

SEAMTRACK SL (hereinafter, “SEAMTRACK”) respects your privacy and is committed to protecting your personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD), as well as with the applicable rules on cookies and information society services.

This Policy describes how we process personal data through the website www.vigilo.es (hereinafter, the “Website”). If you are a SEAMTRACK customer, please also see the Customer privacy notice.

2) Personal data we collect

SEAMTRACK may process the following data, depending on how you interact with the Website and/or our contact channels:
- Identification and contact data: first name and surname, company, email, telephone number, address (where provided).
- Browsing data: IP address, device/browser identifiers, pages visited, date and time, traffic source, technical information and cookies.
- Data you provide voluntarily: the content of forms, emails, enquiries and demo or quote requests.

3) Purposes of processing

We process your personal data for the following purposes:
a) Handling enquiries and contact, quote or demo requests.
b) Managing the pre-contractual relationship (following up on your request and related communications).
c) Improving the Website and the user experience (analytics and performance, where consent has been given for non-essential cookies).
d) Complying with the legal obligations applicable to SEAMTRACK.
e) Security: preventing misuse and fraud and protecting the Website.

4) Legal bases (legitimacy)

The legal bases for processing your data are:
a) Performance of pre-contractual measures (Art. 6(1)(b) GDPR): when you request information, a quote or a demo.
b) Consent (Art. 6(1)(a) GDPR): where you give it, for example for non-essential cookies or to receive marketing communications if that option is enabled.
c) Legitimate interest (Art. 6(1)(f) GDPR): to guarantee the security of the Website, prevent fraud and respond to communications relating to your request, as well as for strictly necessary basic statistics (always respecting your rights and the cookie rules).
d) Compliance with a legal obligation (Art. 6(1)(c) GDPR): where necessary in order to respond to legal requirements or requests from the authorities.

5) Data recipients and processors

SEAMTRACK does not sell or disclose your data to third parties. However, in order to provide the service and operate the Website, we may use suppliers (data processors), for example:
- Web hosting/infrastructure and IT services.
- Email or support providers (where applicable).
- Analytics or measurement providers (only if you consent to the corresponding cookies).

These suppliers process the data on SEAMTRACK's instructions and under contracts that comply with Art. 28 GDPR.

6) International transfers

As a general rule, SEAMTRACK seeks to ensure that data is processed within the European Economic Area (EEA). Should any supplier process data outside the EEA, appropriate safeguards will be applied (for example, Standard Contractual Clauses approved by the European Commission or other valid mechanisms under the GDPR).

7) Retention periods

We will keep your data for as long as necessary to fulfil the purposes set out above:
- Enquiries/requests: while they are being handled and, thereafter, for the periods needed to address any potential liabilities (normally up to 12 months, unless the nature of the request calls for a different period).
- Marketing communications (if you accept them): until you withdraw your consent or unsubscribe.
- Cookie data: according to their type and the duration stated in the cookie settings.
- Legal obligations: for the periods required by the applicable legislation.

8) Your rights

You may exercise the following rights:
- Access, rectification, erasure.
- Restriction of processing, objection.
- Portability (where applicable).
- Withdrawal of consent at any time (without affecting the lawfulness of prior processing).

To exercise them, write to rgpd@seamtrack.com setting out your request and, where necessary, providing proof of your identity.

In addition, if you believe that your rights have not been properly addressed, you may lodge a complaint with the Spanish Data Protection Agency (AEPD).

9) Marketing communications

We will only send you marketing communications by electronic means where:
a) You have given your consent; or
b) There is a prior relationship and the communication relates to similar products/services, in accordance with the applicable legislation, always offering you a simple way to unsubscribe.

10) Security

SEAMTRACK applies reasonable technical and organisational measures to protect your data (for example, access control, encryption/SSL where appropriate, and security measures on our systems). No system is completely infallible, but we work to minimise risks and keep our protection measures up to date.

11) Call recording

Should SEAMTRACK record telephone calls, you will be informed beforehand and told the purpose (for example, quality control or security), the legal basis and the applicable retention period.

12) Cookie Policy

Cookies are small files stored on your device to allow the Website to work, remember preferences or measure how the site is used.

On the Website we may use:
